These terms and conditions apply to all agreements entered with Elya Tettelin unless explicitly and in writing deviated from by the parties.

Deviation from what is stipulated in these terms and conditions is only possible if explicitly agreed upon in writing, in which case the other provisions of these terms and conditions remain in full force.

Elya Tettelin reserves the right to amend or supplement these terms and conditions from time to time.

1. Copyright protection

Elya Tettelin releases a high-quality collection of jewelry under its own name. All jewelry manufactured under the name of Elya Tettelin is protected by national and international laws (such as intellectual property rights) and belongs to Elya Tettelin. It is prohibited to reproduce, modify, disclose, distribute, or resell the name Elya Tettelin and/or jewelry manufactured under the name of Elya Tettelin.

2. Errors and typos

The information, images, and prices displayed on the website regarding the characteristics of the products are presented as accurately as possible. Elya Tettelin cannot be held responsible for any typos, errors, and/or incorrect information on the website.

 

3. Exchanges

Only jewelry from the regular collection, in its original packaging, along with all accessories, instructions for use, warranty certificate, and proof of purchase, can be returned and exchanged for a product of equal value or, upon payment of a surcharge by the customer, for a product of higher value, or exchanged for a gift voucher of the product's purchase value. Returned products cannot be exchanged for cash.

Any jewelry designed and made at the request of the customer cannot be returned or exchanged. Once the deposit has been paid, the order cannot be cancelled.

 

4. Privacy

Elya Tettelin respects the privacy of all users of its site and ensures that the personal information you provide to us is treated confidentially. We use your data to process orders as quickly and easily as possible. Furthermore, we will only use this data with your permission. Elya Tettelin uses the collected data to provide its customers with the following services: "If you leave your email address, you will be added to the mailing list for our newsletter. This is sent approximately 8 times a year." Elya Tettelin will not sell your personal data to third parties and will only make it available to third parties involved in processing your order. Our employees and third parties engaged by us are obliged to respect the confidentiality of your data.

6. VAT-free purchase

Elya Tettelin offers customers the opportunity to purchase jewelry VAT-free. In a VAT-free purchase, customers pay Belgian VAT (21%) upon purchase of the jewelry. This VAT is refunded when the jewelry is exported to a country outside the EU.

For inspection by customs at a European exporting airport, you need the following:

  1. The purchased product + purchase invoice of this product: The purchase invoice must be stamped by customs at the European exporting airport so that the VAT can be reclaimed from Elya Tettelin.

  2. Passport: The customer must possess a passport indicating that the person is a non-EU resident.

  3. Plane ticket: The customer must possess a plane ticket indicating that the person will leave the EU.

Export must take place within 3 months after purchase/invoice date. The VAT refund will only be processed by Elya Tettelin upon receipt of the purchase invoice (mentioning the purchased product), stamped by customs at the European exporting airport. The returned stamped invoice must be received by Elya Tettelin no later than 2 months after stamping. Repayment can only be made if Elya Tettelin clearly receives the customer's IBAN and BIC or SWIFT code. Repayment is made in accordance with the legal European rules, determined by the Belgian Chamber of Commerce (Article 8, 4° of the royal decree No. 18 states that the seller must prove the authenticity of the export by means of a copy of the invoice or of a document deemed valid for this purpose by the customs office of exit from the Community). These rules confirm that the invoice of the purchased product is sufficient for customs inspection. According to Belgian and European legislation, no other document is necessary. Elya Tettelin is not liable for any issues that may prevent customers from exercising the right to VAT-free purchases. (E.g. closure of the customs office preventing the acquisition of a stamp, loss of the stamped invoice by the customer through mail, receipt of incorrect bank details by the customer, etc.) Unless Elya Tettelin is obliged to do so, all import and export duties or other local taxes are borne by the customer.

 

7. Certificates

Elya Tettelin only uses high-quality materials and diamonds in jewelry. With each purchase, the customer receives an in-house certificate describing the qualities of the purchased jewel. For each diamond jewelry equal to or larger than 1.0ct, the customer receives a certificate from a recognized laboratory describing the 4C’s of the diamond.

 

8. Warranty

All jewelry is manually manufactured and checked by professionals with years of experience during the production process. Additionally, all jewelry undergoes a quality control check again just before delivery to the customer. To claim warranty, the customer must present the purchase receipt. Customers are advised to keep the original packaging. Warranty never applies to defects resulting from accidents, negligence, falls, abnormal or incorrect use, use of the item contrary to its intended purpose, non-compliance with usage instructions or manual, alterations or modifications to the item, rough handling, poor maintenance, or any other abnormal or incorrect use. Warranty also does not apply to items with a shorter lifespan or wear items. Defects manifesting after a period of 12 months following the date of purchase are deemed not to be latent defects, unless proven otherwise by the customer. Warranty is not transferable.

 

9. Complaints

Elya Tettelin expressly asks customers to carefully inspect the purchased products immediately upon receipt. Customer complaints regarding product defects that are visibly apparent must be reported by the customer immediately upon delivery. In the event that a complaint is not satisfactorily resolved to the customer's satisfaction, the customer has access to Belmed, the mediation service of the Federal Public Service Economy, which will examine the file and mediate to achieve a solution acceptable to both parties. Through the online platform Belmed, disputes between consumers and traders and between traders themselves can be settled outside of court and via the internet through the intervention of an independent mediator. Consultation of the platform is free. The potential cost of mediation via Belmed depends on the involved mediation authority. Even if paying, mediation is often cheaper than a lawsuit!
